Introduction

This Acceptable Use Policy ("AUP") defines the rules and guidelines for using VividDraw. By using the Service, you agree to comply with this policy. Violations may result in account suspension or termination.

Prohibited Content

You may not generate, upload, or share content that:

• Illegal Content: Violates any applicable local, national, or international law.
• Sexually Explicit Material: Contains pornography, sexual acts, or sexually explicit depictions, including non-consensual intimate imagery.
• Child Exploitation: Depicts or involves minors in any sexual or exploitative context.
• Graphic Violence: Depicts extreme violence, gore, torture, or cruelty.
• Hate Speech: Promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Harassment & Bullying: Targets individuals with threats, intimidation, or repeated unwanted contact.
• Personal Information: Exposes private information of others without consent (doxxing).
• Misinformation: Creates deceptive content intended to mislead or defraud others.
• Copyright Infringement: Uses copyrighted material without authorization or license.
• Trademark Violation: Impersonates brands, organizations, or individuals.

Prohibited Conduct

When using VividDraw, you may not:

• Attempt to circumvent rate limits, security measures, or access controls.
• Use automated scripts, bots, or scraping tools to interact with the Service.
• Share your account credentials with others or allow multiple people to use a single account.
• Create multiple accounts to evade bans, abuse free credits, or manipulate the Service.
• Reverse engineer, decompile, or extract the underlying AI models.
• Interfere with the Service's operation through denial-of-service attacks or excessive load.
• Resell, sublicense, or redistribute access to the Service without authorization.
• Impersonate VividDraw staff, moderators, or administrators.

AI-Specific Restrictions

In addition to the general prohibitions above, the following AI-specific restrictions apply:

• Deepfakes: Do not generate realistic images of identifiable individuals without their explicit consent.
• Model Extraction: Do not attempt to reconstruct, replicate, or extract the AI models used by VividDraw.
• Prompt Injection: Do not craft prompts designed to make the AI generate prohibited content or bypass content filters.
• Benchmarking: Do not use the Service for competitive benchmarking, model comparison, or training other AI systems without prior written consent.
• Training Data Extraction: Do not attempt to extract training data from the AI models.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• Ensuring your email address is current and accessible.
• Promptly notifying us of any unauthorized access to your account.
• All activities that occur under your account.

We are not liable for losses caused by unauthorized use of your account resulting from your failure to secure your credentials.

API and Automation

Automated access to the Service is subject to the following:

• Rate limits apply and are enforced automatically.
• Exceeding rate limits may result in temporary or permanent access restrictions.
• Use of multiple accounts or IP addresses to circumvent rate limits is prohibited.
• Programmatic access beyond normal browser usage must be explicitly authorized by us in writing.

Intellectual Property

Respect the intellectual property rights of others:

• Only upload or use content you own or have permission to use.
• Do not use the Service to create derivative works of copyrighted material without authorization.
• If you believe content on VividDraw infringes your copyright, follow our DMCA notice procedure.

Enforcement

We may use automated systems, user reports, and manual review to detect potential violations of this policy.

We reserve the right to enforce this policy through:

• Content Removal: Prohibited content may be removed without prior notice.
• Account Suspension: Temporary suspension pending investigation.
• Account Termination: Permanent termination for severe or repeated violations.
• Reporting: Violations involving illegal content may be reported to law enforcement.

Our enforcement decisions are made at our sole discretion and are final.

Appeals

If you believe your account was suspended or terminated in error:
